  1. Conditions Terms of Service scope
    These General Terms and Conditions (GTC) apply to all contracts Nightshift Healthcare GmbH with consumers (§13 BGB) that are made via our online shop.

  1. Contractual partner, retention of title.
    The purchase contract is concluded between Nigthshift Healthcare GmbH and the consumer who has purchased a Nightshift Healthcare GmbH product.
    The object of purchase remains the property of Nightshift Healthcare GmbH until payment, i.e. until the money has been received on the Nightshift Healthcare GmbH account.

  1. Conclusion of contract.
    The presentation of the products in the online shop is not a legally binding offer, but a non-binding online offer. By clicking the order button, the customer places a binding order for the goods in the shopping cart. The confirmation of the receipt of the order takes place together with the acceptance of the order immediately after sending by an automated email. With this e-mail order, the sales contract came into being.

  1. Contract language.
    The contract language is German.

  1. Delivery Terms.
    In addition to the stated product prices, there are also shipping costs. The delivery takes place on the dispatch route. It is not possible to collect the goods yourself.

  1. Pay
    The following are available in our online shop to pay for the goods:

  • PayPal
    You will be redirected to the PayPal website. The payment transaction is then carried out under the responsibility of PayPal and is carried out automatically after you have confirmed the payment order.

  • Payment in advance
    If you choose the payment method “advance payment”, you transfer the amount to our bank account. You will then receive the ordered goods after receipt of payment.

  1. On Bill
    A right to offset only exists if the counterclaims have been legally established by a court or have been recognized in writing by Nightshift Healthcare GmbH.

  1. Right of retention
    A right of retention can only be exercised if the claims result from the same contractual relationship.

  1. Right of withdrawal
    Consumers have a fourteen-day withdrawal. The right of withdrawal begins on the day on which you or an authorized representative who is not the carrier took possession of the product, i.e. on the completed delivery.

    This return must be accompanied by a declaration that you are canceling the purchase contract. The costs for the goods including the costs of delivery are taken over. The remittance will be made within 14 days after receipt of the cancellation by Nightshift Healthcare GmbH. The same means of payment will be used for the repayment as the one chosen for the purchase. Nightshift Healthcare GmbH does not bear the delivery costs of the return. There is no right of withdrawal if
    – the seal of sealed goods has been opened
    – the seal has been removed after delivery
    – the goods are unsuitable for return for reasons of hygiene or health protection, e.g. if the goods were carried in the mouth.

  1. Warranties and guarantees
    All Nightshift Healthcare GmbH products are manufactured according to European industrial standards. The statutory right to liability for defects applies. Due to the manufacturing-related aging of the material from which the “Gaumfit” palate trainer is made, the plastic is only guaranteed for 6 months from the date of purchase.

  1. Liability
    Product liability is granted in accordance with statutory regulations. No liability is accepted for damage resulting from improper use of Nightshift Healthcare GmbH products.

  1. Place of jurisdiction
    The place of jurisdiction is Hamburg. German law applies.
